This website is operated by Smart Electrics (hereinafter referred to as "we", "us" or "our"). Please read these terms and conditions carefully. By submitting an order on this website you are agreeing to the terms that appear below (as amended from time to time). The terms that will govern your purchase will be those in effect at the date of your order. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions and which offer we will be entitled to accept or reject for any reason whatsoever, without any recourse. Description of Goods All the products we sell are of a technical nature and it is therefore not practical to publish detailed specifications of them all. All images, descriptive matter, specifications and advertising on our site are provided for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from us on request or from the manufacturers or their websites (where available). Availability of Goods All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods. Prices Although we will use our best efforts to ensure that prices reflected on the website are accurate and current, because of the nature of the goods, prices change and are subject to change without notice. In the event that the price to be charged is more than the price reflected on the website, in respect of any goods, we will advise you thereof, by email, prior to delivery thereof, thus giving you the opportunity to accept or reject any higher price. Emails sent to you but not responded to within 7 (seven) days of us sending the email will be deemed to be an acceptance of the higher price. Payment Terms Under normal circumstances, goods must be paid for prior to dispatch.
If for any reason, goods are agreed to be shipped prior to clearance of payments, title in the goods shipped belongs to Smart Electrics until payment for the goods is received by us in full.
Where an account has been approved by the Company, unless otherwise agreed in writing, payment shall be made by the end of the month following that in which the invoice is dated.
Payments for all services made, must be received by us within 14 days at the latest to avoid interest and compensation charges. You may be charged for a deposit of 20% before the service commence.
Methods of Payment Smart Electrics accepts payment by cheque, cash, credit or electronic funds transfer and credit or debit cards.
Website payments are processed online using the Paypal secure payment service. Prices are shown in Euros. Credit cards are pre-authorised immediately using the Paypal secure system, after which point various additional security checks are made. As part of our commitment to the security of our customers we may contact you to request further validation of your details.
Payments by credit or debit card may be made at our office or by phone at 01 620 55 30.
Cheques may be sent by post to Smart Electrics, Unit 10 Canal Walk, Parkwest Industrial Park, Dublin 12, Ireland or delivered to our offices between 8 am and 5 pm Monday to Friday.
Payment by cash is accepted in our offices. Cash should not be sent by post.
Please DO NOT send credit card details by e-mail. Our online store includes a considerable level of security that is not included in e-mail. If you have any queries about making payments please contact us.
Credit transfers may be made using the pre-printed payment slip at the bottom of the statement of account sent monthly.

Rates of Interests The European Communities (Late Payment in Commercial Transactions) Regulations 2002 govern payment terms on all sales in Ireland.
From the 1st January 2010, the late payment interest rate is 8% per annum (that is based on the ECB rate of 1% plus the margin of 7%). That rate equates to a daily rate of 0.022%. Penalty interest due for late payments should be calculated on a daily basis. The ECB rate can be checked on the Central Bank and Financial Services Authority of Ireland website www.centralbank.ie.
From 1 July 2010 you should check the Department of Enterprise, Trade and Employment’s website (see Associated Links) for the latest applicable late payment interest rate.
Under these regulations payment must be made within 30 days and interest at 8% rate will be charged on a daily basis for all late payments. As well as interest, set compensation is also payable at €40 per payment for amounts under €1,000 or €70 per payment for amounts to €10,000 and €100 for over €10,000. These rates and amounts are set in the regulations and not subject to negotiation.
Smart Electrics is fully committed to complying with these regulations in our payments to suppliers and equally committed to enforcing its provisions with regard to payments from our customers.
If an invoice is disputed, Smart Electrics will only accept such a dispute if the reasons are given in writing (by post, fax or email) before the 30th of the month following supply of goods or services. In such cases, Smart Electrics will respond immediately and the period of 30 days for payment will apply from the date of the written response from Smart Electrics. Delivery Charges We will charge to deliver all goods purchased from us. Delivery charges will vary, depending on where the delivery is to be affected. Delivery charges will need to be paid for together with payment for the goods. Delivery Dates and Delays 95 percent of goods purchased on this site are delivered nationwide by Fastway or Nightline couriers within 2-3 days of you placing your order. We will contact you if a delivery is going to take longer than we would normally expect. We will endeavor to deliver goods within these time periods, but goods are subject to availability and delay in the delivery of goods is frequently in the hands of a third party and sometimes outside our control. Carriers cannot specify an exact hour of delivery. Any dates we specify for the delivery of goods are approximations only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in the delivery of the goods. Our failure to meet approximate delivery dates will not be grounds for you to cancel the sale. Some orders may be delivered in more than one drop. We will only deliver goods to the address on the order and goods will not be left without a signature. You are required to make all the necessary arrangements to take delivery of the goods whenever they are tendered for delivery. If you are not at home on the date that has been agreed and the delivery agent cannot contact you, we reserve the right to charge you for the re-delivery. Inspection of goods It is your responsibility to ensure that there is a responsible person at the delivery address to inspect and to sign for the goods. . We cannot accept liability for damages or errors if goods have been fitted or if you have had the goods in your possession for more than 7 (seven) days. PLEASE ENSURE THAT YOU KEEP THE ORIGINAL PACKAGING IN CASE YOU HAVE ANY REASON TO RETURN YOUR PURCHASE (subject to our returns policy set out below). You must notify in us writing if a product has been delivered incomplete within 7 (seven) days of your receipt thereof. Risk The risk in the goods shall pass to you, the customer, on arrival at the delivery address, as advised by you. Faulty Goods Whilst we strive to ensure that all goods reach you in perfect condition, there are unfortunately times when this does not happen. If you should receive damaged or faulty goods from us you may contact us within 14 days of receiving your order to arrange a replacement or full refund. A customer service representative will discuss arrangements for return of the damaged goods and issuing a replacement or refund with you. If you would like to return damaged or faulty goods please ensure that you contact us prior to sending them back. This guarantee does not affect your statutory rights as a consumer. If a product is returned as faulty, but is not deemed to be faulty by us, the product will be returned back to you. This will be done subject to an administration fee equivalent to 10% of the price of the goods along with the cost of delivery in an amount equivalent to the original delivery charge, which will be charged to your credit card account. PLEASE NOTE THAT NOTWITHSTANDING ANYTHING WHICH IS SET OUT ABOVE, IN ORDER TO SUCCESSFULLY OBTAIN AN EXCHANGE OR REFUND FOR FAULTY GOODS THE GOODS MUST BE RETURNED COMPLETE WITH ALL ACCESSORIES IN THEIR ORIGINAL BOX AND PACKAGING. Guarantees All products supplied are covered by the terms and conditions of the manufacturer's guarantee. No further or additional warranties or undertakings will be given by us in regard to the goods. Non-Deliveries We will not accept liability for goods lost in transit unless we are notified within 7(seven) days from the expected delivery date. Refunds Refunds will be at our discretion and will be made to the same credit card that was used for the transaction, within 30 (thirty) days of notification to you that a refund is due to you. Returns Policy Returns to us will be at your expense. If we, for some reason pay the costs relating to any return by you, we shall be entitled to claim a refund of any such payment from you and you shall refund any and all amounts to us on demand. We do not accept returns unless the goods supplied by us are in their original packaging and have not been opened by you. Notwithstanding what is set out above, we advise that all returns will be at our discretion and you will not be entitled in any way to dispute or query our discretion, once exercised by us. Subject to what is recorded under this returns policy clause, if returns are received by us after 7 (seven) days from the date of delivery, we will not be obliged to accept the returned goods for the purpose at all. Privacy Statement We are committed to protecting your privacy. We will only use the information that you provide, for lawful purposes. We obtain information about you only to process your order and provide you with the best possible service. We will endeavor to ensure that the information we hold will be accurate and up to date and we agree keep such information secure. Restrictions on use of material No material from www.smartelectrics.ie or any website owned, licensed or controlled by Smart Electrics may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, without the prior written consent of Smart Electrics. Modification of the materials or use of the materials for any other purpose is a violation of Smart Electrics’s copyright and other rights. In the event that you download software from the site, the software, including any files, images incorporated in or generated by the software, and data accompanying the software are licensed to you by Smart Electrics and Smart Electrics retains full and complete title to all information contained within this site. Trademarks All company names, logos, trademarks, product names, images or photographs displayed in this website are the property of their respective owners. Amendment to Terms Smart Electrics reserves the right to amend these terms and conditions without notice. Disclaimer It is our intention that all information on this website is as accurate and up to date as possible. However, we cannot guarantee this. We shall have the right to refuse or cancel any orders to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. Errors on our website are rare, but mistakes can happen. In the unlikely event of an error in price being made on our website, we will contact you and give you the opportunity to amend or cancel your order. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges). We will not be liable for any injuries or financial loss from accidents related to the order or loss of time and monies resulting from delays, non-deliveries and wrong delivery.
